Terms of Service

These Terms of Service ("Terms") govern your use of the IQ Locations website at iqlocations.com and all reports, subscriptions, data, and services provided by Hollow Draw, LLC, a Texas limited liability company doing business as IQ Locations ("IQ Locations," "we," "us," or "our"). By accessing the site, purchasing a report, or subscribing to any paid plan, you agree to be bound by these Terms. If you do not agree, do not use the site or purchase any product.

1. Service Description

IQ Locations generates site-intelligence reports that compile publicly available demographic, traffic, competition, and economic data for a user-specified address in the United States. Reports are delivered as downloadable PDF files. We offer both single-report purchases and monthly subscription plans for business partners (collectively, "Services").

2. Not Investment, Financial, Legal, or Real Estate Advice

Reports are analytical tools intended to support — not replace — independent due diligence. Analytical summaries, benchmarks, population projections, AI-generated narratives, competitor data, and all other content in a report do not constitute investment, financial, legal, tax, real estate, or site-selection advice. Hollow Draw, LLC is not a licensed real estate broker, financial advisor, investment advisor, appraiser, or attorney.

You should always consult qualified professionals before making any investment, acquisition, site selection, leasing, lending, or business decision. We are not responsible for any decision you or any third party makes based on report content.

No Reliance. You acknowledge and agree that you are not relying on the Services or any report as a substitute for independent analysis, professional advice, or your own due diligence, and that any reliance on the Services is at your own risk. You further acknowledge that you have the experience and judgment necessary to evaluate the limitations of report content and to make your own business decisions.

No Guarantee of Results. We do not guarantee any business outcome, investment return, transaction completion, site-selection success, lease outcome, or other result from your use of the Services. Past performance of similar analyses, if any, does not predict future outcomes.

3. Intended Use; Fair Housing and Compliance Restrictions

Reports are intended for commercial site analysis and business due diligence only. Reports are NOT designed for, and MAY NOT be used in connection with:

  • Residential real estate transactions
  • Mortgage lending decisions or underwriting
  • Insurance underwriting or pricing
  • Employment decisions
  • Credit decisions governed by the Equal Credit Opportunity Act
  • Any decision governed by the Fair Housing Act, the Americans with Disabilities Act, or similar federal, state, or local laws prohibiting discrimination based on protected characteristics

Reports contain demographic data sourced from the U.S. Census Bureau that includes information on race, ethnicity, age, income, and household composition. You assume all responsibility for ensuring your use of report data complies with applicable law. You agree to indemnify and hold us harmless from any claim arising from your use of reports in a prohibited context.

4. Data Sources and Accuracy

Reports draw from third-party public and commercial data sources including, but not limited to:

  • U.S. Census Bureau American Community Survey (ACS) 5-Year Estimates
  • U.S. Census Bureau County Business Patterns (CBP)
  • U.S. Census Bureau LEHD LODES (workplace area characteristics)
  • U.S. Department of Housing and Urban Development (HUD) subsidized housing data
  • Federal Highway Administration (FHWA) Highway Performance Monitoring System (HPMS) traffic counts
  • Google Places API (competitor locations, ratings, reviews)
  • Mapbox (mapping and geospatial visualization)
  • Other publicly available government and commercial data sources

We do not warrant the accuracy, completeness, timeliness, or reliability of any third-party data. Report data reflects conditions at the time of generation and may not reflect subsequent changes. Population figures beyond the most recent ACS release are linear extrapolations and are labeled as such in the report. Industry benchmarks are directional in nature, derived from published trade-association research and our own analysis, and should not be relied upon as authoritative. Competitor data reflects snapshots from Google Places at the time of report generation and may be incomplete or outdated.

Point-in-Time Snapshots. Reports are generated as point-in-time snapshots and reflect data available at the moment of generation. Demographic conditions, traffic patterns, competitor presence, and economic indicators change over time. Reports should not be relied upon as accurate representations of current conditions more than 90 days after the generation date. We recommend re-running reports before making any final business decision based on report content.

5. AI-Generated Content

Certain narrative and summary content within reports is generated by artificial intelligence systems. AI-generated narrative sections are clearly labeled within each report. While we review our AI generation systems for quality and accuracy, AI-generated content may occasionally contain errors, omissions, or interpretations that do not match the underlying data. AI-generated content should be evaluated alongside, and never in place of, the underlying data tables and your own independent judgment.

6. Purchases, Subscriptions, and Payment

Single Reports. Single reports are available at the price displayed at checkout, currently $29 per report. Payment is due at the time of purchase.

Subscription Plans. We offer monthly subscription plans for business partners at tiers including a defined number of included reports per month. Additional reports beyond the monthly allowance are billed as overages at the per-report rate disclosed at signup. Current subscription tiers and overage rates are displayed on the pricing page and incorporated into these Terms by reference.

Auto-Renewal. Subscription plans automatically renew each month at the then-current rate until cancelled. By subscribing, you authorize us to charge your payment method on each renewal date.

Cancellation. You may cancel a subscription at any time through your account dashboard or by emailing shane@iqlocations.com. Cancellation takes effect at the end of the current billing period. You will retain access to your subscription benefits through the end of that period. No prorated refunds are provided for partial months.

Price Changes. We may change subscription prices with at least 30 days' advance notice by email. If you do not agree to a price change, you may cancel before it takes effect.

Payment Processing. All payments are processed by Stripe, Inc. By completing a purchase you also agree to Stripe's terms of service. Prices are listed in U.S. dollars.

Non-Payment. If a payment fails, we may suspend or terminate your account and access to Services.

7. Refund Policy

Single Reports. You may request a full refund within 14 days of purchase if:

  • The report contains a material data error (e.g., incorrect address geocoding, missing sections, or substantially inaccurate data)
  • The address you entered is outside our coverage area and we were unable to generate a usable report
  • The report failed to generate due to a system error on our end

To request a refund, email shane@iqlocations.com with your order confirmation. Refunds are processed within 5–10 business days to the original payment method.

Refunds are not available solely because you are dissatisfied with the analysis, conclusions, or other subjective evaluations in a report, as these reflect objective data inputs and documented methodology.

Subscriptions. Subscription fees are non-refundable. Cancellation takes effect at the end of the current billing period as described in Section 6. Overage charges are non-refundable once the additional report has been generated.

8. Account Terms

Account Creation. Certain Services require an account. You are responsible for maintaining the confidentiality of your account credentials and for all activity under your account. You must notify us immediately of any unauthorized access.

Team Accounts. Subscription plans may permit multiple authorized users under a single account. The primary account holder is responsible for the conduct of all authorized users and for ensuring each user's compliance with these Terms.

Accurate Information. You agree to provide accurate, current, and complete information at signup and to keep your account information up to date.

Termination. We may suspend or terminate your account at any time for violation of these Terms, non-payment, suspected fraud or abuse, or misuse of the Services. You may terminate your account at any time through your account dashboard or by emailing shane@iqlocations.com. Upon termination for any reason: (a) your right to access the Services ends immediately; (b) we have no obligation to retain, return, or provide access to any reports, data, or account content; (c) any fees paid are non-refundable except as expressly provided in Section 7; and (d) you remain responsible for any fees accrued through the termination date, including overage charges. You are solely responsible for downloading and retaining copies of any reports you wish to keep before cancellation takes effect. Sections 2, 3, 9, 11, 12, 13, 14, 15, 16, and 20 survive termination.

Age Requirement. You must be at least 18 years old to create an account, purchase a report, or subscribe to any plan. The Services are intended for business use by adults and are not directed to minors. By using the Services, you represent that you are at least 18 years of age.

9. Data Retention and Deletion

We may retain, archive, or delete reports, account data, or inactive accounts in our sole discretion. Without limiting the foregoing:

  • Reports may be stored for your convenient retrieval, but we make no commitment as to the duration of storage
  • We may delete reports, data, or accounts that have been inactive for 12 months or more, with or without notice
  • We may purge or anonymize historical data for operational, storage, security, or compliance reasons
  • Deletion of report data does not constitute a refund event

You are solely responsible for downloading and retaining copies of any reports or data you wish to preserve. Certain data may be retained in backup systems, audit logs, or aggregated analytics after account-level deletion; such retention is limited to legitimate business, legal, or security purposes and is addressed in our Privacy Policy.

10. Beta and Experimental Features

Certain features, data sources, analytical models, or report sections may be designated as "beta," "preview," "experimental," or similar. Beta features are provided "as is" for evaluation purposes, may contain errors or omissions, may change significantly without notice, may be subject to additional terms, and may be discontinued at any time without refund or replacement. Your use of beta features is voluntary. We welcome feedback on beta features through the contact methods in Section 25.

11. Intellectual Property; License to Use Reports

Our IP. All report templates, site design, methodology, data aggregation systems, software, and IQ Locations branding are the property of Hollow Draw, LLC and are protected by copyright, trademark, and trade secret law.

License for Single-Report Buyers. Upon purchase of a single report, we grant you a limited, non-exclusive, non-transferable license to use the report for your own internal business due diligence. You may not resell, redistribute, publicly publish, or rebrand the report without our prior written consent.

License for Subscription Partners. If you are an active subscriber on a paid partner plan, we grant you a broader license to:

  • Apply your own business's logo, contact information, and branding to reports generated under your subscription
  • Deliver co-branded or white-labeled reports to your clients, customers, buyers, or prospects in the ordinary course of your business
  • Use reports as marketing collateral or due diligence deliverables to support transactions you are involved in

This partner license is conditional on the following: (a) your subscription remains in good standing; (b) you do not represent that you generated the underlying data or methodology; (c) you do not remove legally required disclaimers or compliance language embedded in the report; (d) you do not resell reports as a standalone product or service competitive with IQ Locations; and (e) your use complies with Section 3 (Intended Use) and Section 12 (Acceptable Use). We may require a separate written partner agreement for certain subscription tiers, and the terms of that agreement will supplement and, where inconsistent, supersede this Section 11.

Feedback. If you provide suggestions or feedback about the Services, you grant us a perpetual, royalty-free license to use and incorporate that feedback without obligation.

12. Acceptable Use

You agree not to:

  • Use the Services in violation of any law or the rights of any third party
  • Reverse engineer, decompile, scrape, or attempt to derive the source code or underlying data architecture of the Services
  • Use automated means (bots, scrapers, crawlers) to access the Services beyond ordinary use
  • Attempt to bypass rate limits, authentication, or access controls
  • Resell, sublicense, or transfer access to your account or the Services, except as expressly permitted under Section 11
  • Use the Services to build a competing product or service
  • Upload or submit any content that is unlawful, defamatory, or infringing
  • Interfere with or disrupt the Services or any servers or networks supporting them
  • Use the Services, any report content, or any data derived from reports to train, fine-tune, or develop any machine learning model or artificial intelligence system
  • Systematically extract, aggregate, or compile data from multiple reports for the purpose of building a competing dataset or service
  • Benchmark, stress-test, or performance-test the Services without our prior written consent
  • Remove, obscure, or alter any disclaimers, attribution, copyright notices, or compliance language embedded in reports, except as expressly permitted under the white-label partner license in Section 11

We reserve the right to investigate and take action against any violation of this Section, including account suspension or termination.

13. Third-Party Services and Data Sharing

The Services rely on third-party providers including Stripe (payments), Resend (email delivery), Anthropic (AI narrative generation), Google (places data), and Mapbox (geospatial visualization). Use of the Services involves data sharing with these providers. Our data practices are described in our Privacy Policy, which is incorporated into these Terms by reference.

14. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, HOLLOW DRAW, LLC, ITS OFFICERS, EMPLOYEES, AGENTS, AND AFFILIATES SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES ARISING OUT OF OR RELATED TO YOUR USE OF THE SITE, ANY REPORT, OR ANY SERVICES, INCLUDING BUT NOT LIMITED TO LOST PROFITS, LOST BUSINESS OPPORTUNITIES, BUSINESS INTERRUPTION, LOSS OF DATA, OR LOSS OF GOODWILL, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

IN NO EVENT SHALL OUR TOTAL AGGREGATE LIABILITY TO YOU FOR ALL CLAIMS ARISING FROM OR RELATED TO THESE TERMS OR THE SERVICES EXCEED THE GREATER OF (a) THE AMOUNT YOU PAID US IN THE TWELVE MONTHS IMMEDIATELY PRECEDING THE EVENT GIVING RISE TO THE CLAIM, OR (b) ONE HUNDRED U.S. DOLLARS ($100).

Some jurisdictions do not allow the exclusion or limitation of certain damages. In such jurisdictions, our liability is limited to the maximum extent permitted by law.

15. Disclaimer of Warranties

THE SITE, ALL REPORTS, AND ALL SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, TITLE, AND ACCURACY. WE DO NOT WARRANT THAT THE SERVICES WILL BE UNINTERRUPTED, SECURE, ERROR-FREE, OR FREE OF HARMFUL COMPONENTS, OR THAT ANY DEFECTS WILL BE CORRECTED.

No Availability or Uptime Guarantee. We do not guarantee that the Services will be available at any specific time, that reports will successfully generate on any specific attempt, or that reports, data, or account content will be stored or retrievable indefinitely. Service availability may be affected by maintenance, updates, third-party provider outages, or other events. We have no obligation to provide advance notice of outages or service disruptions.

16. Indemnification

You agree to defend, indemnify, and hold harmless Hollow Draw, LLC and its officers, employees, agents, and affiliates from any claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys' fees) arising from or related to:

  • Your use of the Services
  • Your violation of these Terms
  • Your violation of any third-party rights, including intellectual property, privacy, or publicity rights
  • Your use of reports in any context prohibited by Section 3 (Intended Use)
  • Any content you submit, upload, or transmit through the Services

17. Force Majeure

We shall not be liable for any failure or delay in performance caused by circumstances beyond our reasonable control, including acts of God, natural disasters, war, terrorism, riots, labor disputes, government action, internet or telecommunications failures, cyberattacks, or failures of third-party providers (including Stripe, Anthropic, Google, Mapbox, or our hosting providers).

18. Dispute Resolution and Arbitration

Binding Arbitration. Any dispute, claim, or controversy arising out of or relating to these Terms or the Services shall be resolved by binding individual arbitration administered by the American Arbitration Association ("AAA"). For subscription customers, AAA Commercial Arbitration Rules apply. For single-report consumer purchases, AAA Consumer Arbitration Rules apply. Arbitration shall take place in Travis County, Texas, or remotely at the arbitrator's discretion.

Class Action Waiver. You agree that any dispute resolution proceedings will be conducted only on an individual basis and not in a class, consolidated, or representative action. If this class action waiver is found to be unenforceable with respect to a particular claim, that claim (and only that claim) shall be severed from arbitration and brought in court, with the remainder of this arbitration provision remaining in effect.

Opt-Out Right. You may opt out of this arbitration agreement by emailing shane@iqlocations.com with the subject line "Arbitration Opt-Out" within 30 days of first accepting these Terms or creating an account, whichever is earlier. Opting out will not affect any other provision of these Terms.

Small Claims Exception. Either party may bring an individual action in small claims court in Travis County, Texas, if the claim qualifies.

Injunctive Relief. Notwithstanding the foregoing, we may seek injunctive or equitable relief in any court of competent jurisdiction to protect our intellectual property or confidential information.

19. Governing Law and Venue

These Terms are governed by and construed in accordance with the laws of the State of Texas, without regard to its conflict-of-laws principles. Subject to Section 18, any litigation shall be brought exclusively in the state or federal courts located in Travis County, Texas, and you consent to the personal jurisdiction of those courts.

20. Electronic Communications and E-SIGN Consent

You consent to receive communications from us electronically, including notices, agreements, disclosures, receipts, and other information. You agree that all electronic communications satisfy any legal requirement that such communications be in writing. You may withdraw this consent by closing your account, but doing so will terminate your access to the Services.

21. Changes to These Terms

We may update these Terms from time to time. The "Last updated" date at the top reflects the most recent revision. Material changes will be communicated by email to account holders at least 14 days before taking effect. Continued use of the Services after changes take effect constitutes acceptance of the updated Terms.

22. Severability

If any provision of these Terms is found unenforceable, the remaining provisions shall continue in full force and effect, and the unenforceable provision shall be modified to the minimum extent necessary to make it enforceable while preserving its intent.

23. Entire Agreement

These Terms, together with our Privacy Policy and any separate written partner agreement you have signed with us, constitute the entire agreement between you and Hollow Draw, LLC regarding the Services and supersede any prior agreements, discussions, or representations.

24. Assignment

You may not assign or transfer these Terms without our prior written consent. We may assign these Terms without restriction, including in connection with a merger, acquisition, or sale of assets.
